INTRODUCTION

  1. The user/s is/are all persons, natural (18 years or older) or juristic, utilising this website and customers ordering goods or requesting the services provided by Warwick Wine Estate PTY Ltd and are subject to, and bound by, these terms and conditions.
  2. The continued use of this website constitutes the acceptance and understanding of all of the terms and conditions contained herein.
  3. Immediately discontinue use of this website if you do not agree with any and/or all of the terms or conditions contained in this policy and/or you are under the age of 18 years old. In these circumstances, such users may not order any of our goods or make use of any of our services.
  4. The user must be of legal drinking age, 18 years or older, to utilise this website and order goods from Warwick Wine Estate PTY Ltd.
  5. We may change the terms of this policy at any time at our sole discretion, without notice to users. We will endeavour where possible to alert users to any changes by placing a notice in a prominent position on the website or by email.
  6. If you do not agree with any change you must immediately discontinue utilising the website. If you continue to use the website following notification of a change to the terms, the changed terms will apply to you and you will be deemed to have accepted such terms.

PRIVACY & PERSONAL INFORMATION

  1. The privacy of the user is of paramount importance to us and the safety of the user’s personal information is our priority.
  2. Personal information is defined as all information relating to an identifiable, living natural person and where it is applicable, an identifiable, existing juristic person, including but not limited to:
    1. Information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of a person;
    2. Information relating to the education or the medical, financial, criminal or employment history of a person;
    3. Any identifying number, symbol, email address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
    4. The biometric information of the person;
    5. The personal opinions, views or preferences of the person;
    6. Correspondences sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence which would reveal the contents of the original correspondence;
    7. The views or opinions of another individual about the person; and
    8. The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.
  3. Personal Information excludes:
    1. Anonymous that has been made so that it does not identify a specific person;
    2. Permanently de-identified information that does not relate or cannot be traced back to a specific user; and
    3. Non-personal statistical information collected and compiled by us and information that you have provided voluntarily in an open, public space or forum including any blog, chat room, community, classifieds or discussion board. Such information is protected by this policy due to the information not being confidential as it has been disclosed in a public forum.
  4. We will under no circumstances disclose users’ personal information, unless required to do so:
    1. to comply with applicable law or with legal process served on us;
    2. to protect and defend our rights or property;
    3. For the purposes of distributing same to various employees and/or third parties who assist us in providing services to you and thus need to know your personal information in order to render a proper and efficient service to you.
    4. We will ensure that all such employees and/or third party service providers having access to your personal information are bound by appropriate and legally binding confidentiality and non-disclosure obligations in relation to your personal information.
  5. By registering on the website or placing orders resulting from the use of the website, the user understands and accepts that they will no longer be anonymous as they will have provided personal information.
  6. Users may be asked to provide us with additional information on a voluntary basis when you order the goods or request our services.
  7. Users will explicitly be asked when personal, identifying information or information allowing us to contact you is required.
  8. Generally, this information is requested when making reservations and/or when requesting services. Users agree to provide accurate and current information, and not to impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.
  9. We are obliged to disclose users’ personal information if we are required to do so:
    1. by a subpoena or court order;
    2. to comply with any law;
    3. to protect the safety of any individual or the general public; and
    4. to prevent violation of our customer relationship terms.
  10. Users personal information shall be utilised as follows:
    1. For the purposes for which you specifically provided the information;
    2. To assist us in the processing, validating and verification of reservations and requests for services;
    3. To facilitate banking transactions via the website or email;
    4. To deliver any services to users via our website;
    5. Provided users have expressly consented thereto, to receive marketing materials;
    6. To update users on new features, services, special offers and products; and
    7. To improve your experience on our website.
  11. We will not sell personal information. No personal information will be disclosed to anyone except as provided in this privacy policy.

USE OF THE WEBSITE

  10. While you are logged into the website, we may display targeted adverts and other relevant information based on personal information. Devices access and assess your personal information and match it to adverts or related information. We never share personal information with any advertiser, unless you specifically provide us with your consent to do so.
  11. Advertisers receive a record of the total number of clicks for each advert. No personal information is accessible by the advertisers If you click on an advert, you consent that we may send only a referring URL to the advertiser’s website identifying that a customer is visiting from our website. Once you are on the advertiser’s website however, the advertiser is able to collect your personal information and users do so at their sole risk.

Warwick’s Picnic Area T&Cs

  1. One picnic serves two guests only.
  2. Each person booked will be charged R200 for a picnic basket.
  3. Children baskets are R60.
  4. No other food or beverages are allowed on the premises.
  5. No alcohol may be served to guests under 18 years.
  6. Warwick serves the right to refuse entry or service to patrons that are unreasonably rowdy or causing trouble.
  7. In addition to the prix-fixe menu, all drinks will be charged for according to consumption.
  8. Should your party have dietary requirements Warwick must be notified of those two days in advance.
  9. Access to your booked area will be available from 11:00 to 17:00 at which time the area must be vacated.
  10. Last orders from the bar are 16:30.
  11. If specific timings are required, the management must be informed of these in advance.
  12. Warwick wine estate accepts no responsibility for the loss or damage to any personal items.
  13. In case there are any valuables in the car, it must be placed in a car boot and not left on the back or rear seat.
  14. All items are left entirely at the owner’s risk.
  15. If the children make use of the fountain area, they must wear appropriate swimwear at all times.
  16. Children must be under the supervision of parents at all times.
  17. Only small to medium sized socialized dogs are welcome.
  18. Dogs must be leashed at all times.
  19. Dog poop must be picked up by the owner.
  20. 10% Gratuity will be charged on the final bill.
  21. All prices quoted include VAT.
  22. We do not offer customer accounts. All outstanding balances must be settled, in full, at the end of the day.
  23. We accept all major credit cards, Warwick serves the right to ask for identification at times.
  24. Warwick does not accept cheques.

Warwick’s Big Bottle Competition T&Cs

  1. These terms and conditions apply to the Warwick Wine Big Bottle Promotion.
  2. Please read these terms and conditions carefully and by participating in this Competition, all participants irrevocably agree to be bound by these terms and conditions, which will be solely interpreted by Warwick Wine Estate.
  3. Warwick Wine Estate may amend these terms and conditions at any time during the Competition, by posting such amendments on their website (www.warwickwine.com).
  4. The Competition runs from 1 December 2015 until 31 December 2018 and takes place at various Warwick Wine stockists/outlets.
  5. The Competition may be terminated or extended at any time by Warwick Wine Estate. In the event of such termination, all participants agree to waive (give up) any rights they may have in terms of this Competition and acknowledge that they have no recourse of any kind against Warwick Wine Estate or its promotional agents, unless the circumstances leading to such termination were within Warwick wine Estate’s reasonable control.
  6. To enter the Competition you must be 18 years old or older and live in South Africa (being a resident or a citizen). Directors and/or Members and/or Agents and/or Promoters and/or Consultants to Promoters and/or Employees and/or Contractors and/or Family members of any of the aforementioned are not eligible to enter or even claim the prizes.
  7. No prize will be awarded to any person to whom such prize may not be legally awarded including, but not limited to minors under the age of 18 years.
  8. To enter the Competition, entrants must post a picture of themselves with a bottle of wine displayed at any of the designated Warwick Wine stockists/outlets either on the Warwick Wine Estate’s Facebook, Twitter or Instagram account.
  9. Entrants can enter by either posting a picture of themselves with the designated bottle of wine on Twitter/Instagram or Facebook.
  10. Only one picture posted online will win the Prize of 1 case of six bottles wine on a monthly basis.
  11. The winner will be determined randomly on a monthly basis, subsequent to taking into account all valid entries.
  12. The winner will be contacted via the medium where the picture has been posted. The judges ‘decision is final and no correspondence will be entered into.
  13. If the winner cannot be contacted within 10 days, the prize will be forfeited.
  14. The winner agrees to supply a valid identification document (SA ID or passport), proof of address, congratulatory post, and any other validation procedure determined by Warwick Wine Estate, in order to claim the prize.
  15. The winner agrees to have his/her photo taken, which may be used together with their full names by for advertising and promotional purposes, subsequent to receiving the winner’s consent, which consent will not be unreasonably withheld.
  16. The prize includes a case six bottles of wine including reasonable transport fees to deliver the wine and is not transferable.
  17. The prize is not transferable neither can it be exchanged for cash.
  18. Warwick Wine Estate’s external auditors will oversee the competition.
  19. Any violation, attempt and/or suspicion to violate any of these rules will result in the immediate disqualification on the participant. Entrants indemnity Warwick Wine Estate or their respective affiliates for any loss or damage that it or its respective affiliates may suffer because of the Entrant’s breach of these terms and conditions. Consequently, the Entrants agree to compensate Warwick Wine Estate or their respective affiliates for any loss or damage it suffered (including consequential damages and/or legal expenses incurred) because of the Entrant’s breach of these terms and conditions. The Entrants also agree to hold Warwick Wine Estate or their respective affiliates harmless for any claim made against it or their respective affiliates by third parties due to the Entrant’s breach of these terms and conditions.
  20. The prize may not be awarded if entry procedures or these terms and conditions have not been adhered to or if Warwick Wine Estate detects and/or suspects any irregularities or fraudulent practices.
  21. All participants’ indemnify Warwick Wine Estate and any other company associated with the competition and its advertising agencies against any and all claims howsoever from their participation in this competition, unless the circumstances leading to such claim were within Warwick Wine Estate or its advertising agent’s reasonable control.
  22. All participants further indemnify Warwick Wine Estate from any claim should this Competition be called off or extended for any reason whatsoever, unless the cancellation of the Competition has regard to any circumstances within Warwick Wine Estate or its promotional agents reasonable control. Consequently, all participants agree to waive any rights they may have in terms of this Competition and acknowledge that they have no recourse against Warwick Wine Estate or any of its promotional agents.
  23. The winner will be required to sign a detailed indemnity document prior to redeeming or delivery of a prize.
  24. If required, as a result of a change in legislation by the Minster of Trade and Industry or if the Competition is declared unlawful, Warwick Wine Estate reserves the right to terminate this competition immediately and with notice. In the event of such termination, all participants agree to waive any rights they may have accrued in terms of this Competition and acknowledge that they have no recourse against Warwick Wine Estate or its promotional agents, unless the unlawfulness of the Competition has regard to any circumstances within Warwick Wine Estate or its promotional agents reasonable control.
  25. At the end of the competition of all Warwick Wine Estate’s obligations with regard to the Competition as well as with regard to the prize shall cease to exist.
  26. These terms and conditions are severable and are governed by the laws of the Republic of South Africa.

Warwick Fountain Area

Please take note of the following T&Cs with regards to our fountain area.

The Management reserves the right to remove any person from the fountain area whose behaviour is such that it interferes with the comfort and safety of others including acting drunk and disorderly. The fountain area is unsupervised and persons using this area/including unsupervised children do so at own risk. The facility takes no responsibility for damage done to persons or possessions in the area by themselves or others, nor is the facility responsible for loss of possessions left unattended. This includes injuries to minors whilst the minor was strolling unsupervised in the fountain area as well as any consequential damages caused as result of such injury or damage of property.

In order to ensure the enjoyment and safety of all who use the fountain area, please follow these rules:

  1. Running; jumping and other activities are strictly prohibited.
  2. Items not directly designed for use in a fountain area not to enter the water.
  3. Conventional swimwear is to be used at all times.
  4. Consumption of food is prohibited in the fountain area.
  5. Drunk and disorderly conduct is prohibited.
  6. The use of the fountain area is to be between the hours of 6:00 am and 8 pm.

#SipSummer Competition T&CS

    Warwick Wine Estate are the organisers of the Competition and will oversee the Competition and draw the winner, in their sole discretion.
  2. By entering the Competition, you agree that you will receive correspondence from Warwick Wine Estate. You can unsubscribe at any time.
  3. Please read these terms and conditions carefully and by participating in this Competition, all participants irrevocably agree to be bound by these terms and conditions, which will be solely interpreted by the organisers of the #sipsummer competition.
  4. The organisers of the #sipsummer Competition may amend these terms and conditions at any time during the Competition, in their sole discretion, by posting such amendments on their website (www.www.warwickwine.com).
  5. The Competition runs from 20 November 2020 until 7 January 2021 and takes place through the Warwick Wine Estate social media channels – (Facebook & Instagram)
  6. The Competition may be terminated or extended at any time by the organisers, in their sole discretion. In the event of such termination, all participants agree to waive any rights they may have had in terms of this Competition and acknowledge that they have no recourse of any kind against the organisers, their participating partners or their promotional agents, unless the circumstances leading to such termination were within the organiser’s reasonable control.
  7. To enter the Competition, you must be 18 years old or older and live in South Africa (being a resident or a citizen).   11. There will be one winner which will be determined randomly, in the organisers’ sole discretion.
  12. The winner may share the prize with any person of their choice.
  13. The winner will be announced on the 8th of January 2021.
  14. The winner will be announce on Warwick Wine Estate Facebook and Instagram pages.
  15. The organiser’s decision is final and binding on all participants, and no negotiations will be entered into.
  16. If the winners cannot be contacted within 5 calendar days, the prize will be forfeited.
  17. The winners agrees to supply a valid identification document (SA ID or passport), proof of address, congratulatory post, and any other validation procedure determined by the organisers, in order to claim the prize.
  18. The winners agree to have his/her photo taken, which may be used together with their full names for advertising and promotional purposes, subsequent to receiving the winner’s consent, which consent will not be unreasonably withheld.
  19. The prizes is a 5 Litre Warwick Trilogy valued at R3850.
  20. The prizes are not transferable neither can it be exchanged for cash.

  22. Participants indemnify the organisers or their respective affiliates for any loss or damage that it or its respective affiliates may suffer because of the participant’s breach of these terms and conditions.

Consequently, the participants agree to compensate the organisers or their respective affiliates for any loss or damage it suffered (including consequential damages and/or legal expenses incurred) because of the entrant’s breach of these terms and conditions. The participants also agree to hold the organisers or their respective affiliates harmless for any claim made against it or their respective affiliates by third parties due to the entrant’s breach of these terms and conditions.
  24. The prize may not be awarded if entry procedures or these terms and conditions have not been adhered to or if the organisers detect and/or suspects any irregularities or fraudulent practices.
  25. All participants indemnify the organisers and any other company associated with the Competition and its advertising agencies against any and all claims howsoever from their participation in this Competition, unless the circumstances leading to such claim were within the organisers or its advertising agent’s reasonable control.
  26. All participants further indemnify the organisers from any claim should this Competition be called off or extended for any reason whatsoever, unless the cancellation of the Competition has regard to any circumstances within the organisers; its participating partners or its promotional agents’ reasonable control. Consequently, all participants agree to waive any rights they may have in terms of this Competition and acknowledge that they have no recourse against the organisers or any of its promotional agents.

In the event of such termination, all participants agree to waive any rights they may have accrued in terms of this Competition and acknowledge that they have no recourse against the organisers, its participatory partners or its promotional agents, unless the unlawfulness of the Competition has regard to any circumstances within the organisers or its promotional agents reasonable control.
  29. At the end of the Competition, all the organiser’s obligations with regard to the Competition as well as with regard to the prizes shall cease to exist.
  30. It is recorded that no participant/entrant is entitled to any prize, unless expressly advised by the organisers in writing, in their sole discretion.
  31. These terms and conditions are severable and are governed by the laws of the Republic of South Africa.

#Morrison’s Competition T&CS

  1. These terms and conditions apply to the www.warwickwine.com/morrisons promotional Competition (“Competition”).
  2. Warwick Wine Estate are the organisers and promotors of the Competition and will conduct and oversee the Competition and draw the winner, in their sole discretion. 
  3. The prize shall be fulfilled by J.E.Fells, Fells House, Station Road, Kings Langley WD4 8LH and will be made up of Warwick Cape Lady Chardonnay 75cl & Warwick Cape Lady Cabernet Sauvignon 75cl, the quantity of each to be selected by the Competition winner solely, totalling seventy-two bottles delivered to your door in the U.K, valued at £630.
  4. By entering the Competition and providing your express consent as and when necessary, which consent shall not be unreasonably withheld you understand that you may receive promotional emails from Warwick Wine Estate from time to time. You may revoke this consent and unsubscribe at any time.
  5. Please read these terms and conditions carefully and by participating in this Competition, all participants irrevocably agree to be bound by these terms and conditions, which will be solely interpreted by the organisers of the www.warwickwine.com/morrisonsCompetition.

To enter the Competition, participants must obtain a bottle of their favourite Warwick Cape Lady wine from any Morrisons’ store and post a picture of the wine bottle paired with their favourite meal, to Instagram using the hashtag #MyCapeLady. For your entry to be valid you must tag @warwickwineestate and @morrisons and fill in an entry form on the www.warwickwine.com/morrisons website.
  13. No consideration/s will be payable by participants when entering the competition or throughout the Competition.
  14. There will be one grand prize winner which will be determined randomly from all eligible entrants, in the organisers’ sole discretion.
  15. The winner may share the prize with any person of their choice.
  16. The winner will be announced on 2nd February 2020.
  17. The winners will be contacted via email. The organiser’s decision is final and binding on all participants, and no negotiations will be entered into. 
  18. If the winners cannot be contacted within 5 calendar days, the prize will be forfeited.

  31. If required, as a result of a change in legislation or if the Competition is declared unlawful, the organisers reserves the right to terminate this Competition immediately and with notice on the Website. In the event of such termination, all participants agree to waive any rights they may have accrued in terms of this Competition and acknowledge that they have no recourse against the organisers, its participatory partners or its promotional agents, unless the unlawfulness of the Competition has regard to any circumstances within the organisers or its promotional agents reasonable control. 
  32. At the end of the Competition, all the organiser’s obligations with regard to the Competition as well as with regard to the prizes shall cease to exist.
  33. It is recorded that no participant/entrant is entitled to any prize, unless expressly advised by the organisers in writing, in their sole discretion.
  34. Participants are strongly advised to familiarise themselves with the Department of Health Guidelines for safe drinking
  35. These terms and conditions are severable and are governed by the laws of the Republic of South Africa and the United Kingdom as, when and however so applicable, including but not limited to, at the discretion of the Organisers.
